Operator: Space Coast Passport (“VIP Program”) operated by Kemper Kefauver, Realtor® (KeysTo321 / “Keys to 321”), affiliated with Daignault Realty (Merritt Island, FL).
1) Acceptance
By accessing the VIP site, creating an account, adding the wallet pass, checking in, or claiming a perk, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the program.
2) Who We Are
Space Coast Passport is a local community program run by Kemper Kefauver, Realtor. The program promotes local businesses, community events, and—separately—Kemper’s real estate services through Daignault Realty. See the Privacy Policy for how these fit together.
3) Eligibility
You must be 18+ and able to form a contract. Businesses must be legally allowed to offer their perks in Florida. We may verify identity or eligibility.
4) Accounts & Wallet Pass
- You’re responsible for the accuracy of your info and for securing your devices.
- One account per person. No sharing, reselling, or fake check-ins.
- We can suspend or terminate accounts for fraud, abuse, or policy violations.
5) Program Basics (Members)
- Check-Ins: Show your VIP card and complete the check-in flow to unlock a listed perk.
- Perks: Perks are set by each partner. Blackout dates, limits, substitutions, or verification may apply. Partners can change or end offers at any time.
- No Cash Value: Perks aren’t cash or gift cards and can’t be sold or transferred.
- Availability: We don’t guarantee any specific perk, inventory, or business hours.
6) Program Basics (Business Partners)
- Listing: You authorize us to publish your business name, location, perk, and related media you provide. You confirm you own or have rights to the materials you submit.
- Offer Rules: You control your offer and must honor it as displayed at the time of a verified check-in, subject to your clearly posted terms (e.g., blackout dates).
- Compliance: You’re responsible for legal compliance (pricing, alcohol, health, licenses, taxes, accessibility, etc.).
- Data: We share aggregated check-in stats and limited operational info; we don’t share member PII without consent or legal basis.
7) Fair Housing & No Discrimination
As a Realtor, Kemper follows Fair Housing laws. Partners may not refuse service or vary terms based on protected classes (race, color, religion, sex, disability, familial status, national origin, age, etc.). Report issues to kemper@keysto321.com.
8) Acceptable Use
Don’t interfere with the site, scrape content, attempt unauthorized access, misrepresent your identity, or use the program for unlawful purposes. No spam, scams, or malware.
9) Fees
The member program is currently free. Partner fees (if any) will be disclosed at signup and are non-refundable once services render. We may introduce or change fees with notice.
10) Communications
You agree we can contact you about perks, events, account/security, and real estate resources. You can opt out of marketing at any time; essential service messages may still be sent.
11) Privacy
Our Privacy Policy explains what we collect, why, and how long we keep it. We don’t sell personal information. We use service providers under contract. See the Privacy Policy for details.
12) Content & IP
- Our IP: The VIP site, branding, and content are owned by Kemper/KeysTo321 and licensors. All rights reserved.
- Your Content: You grant us a non-exclusive license to use materials you submit (photos, logos, copy) to run and promote the program. You promise you have the rights to share them.
- Trademarks: Third-party marks belong to their owners.
13) Third-Party Services
Maps, wallet passes, payments, analytics, and other tools are provided by third parties under their own terms. We’re not responsible for their sites or services.
14) Real Estate Disclaimers
Any real estate insights provided via the VIP site are general information, not legal, tax, or financial advice. Brokerage: Daignault Realty. Equal Housing Opportunity. For brokerage-specific services, you may be asked to sign separate disclosures/agreements.
15) Changes to Perks or the Program
We may modify, pause, or discontinue features, perks, or the entire program at any time. We’ll try to provide reasonable notice for major changes.
16) Termination
We can suspend or terminate accounts for any violation, fraud, or misuse. You may delete your account at any time; retention rules are in the Privacy Policy.
17) Warranties & Disclaimers
The program is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness, and non-infringement. We don’t guarantee uninterrupted or error-free service.
18) Limitation of Liability
To the maximum extent allowed by law, we’re not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits/revenue. Our total liability for any claim is capped at the greater of $100 or the amount you paid us in the 12 months before the claim.
19) Indemnification
You agree to defend and hold harmless Kemper/KeysTo321, Daignault Realty, and affiliates from claims arising out of your use of the program, your content, your offers (if a partner), or your breach of these Terms.
20) Disputes, Governing Law, Venue
These Terms are governed by Florida law. Courts in Brevard County, Florida have exclusive jurisdiction, unless small-claims rules apply. You agree to bring claims individually (no class actions). If you prefer arbitration instead of court, email us within 30 days of account creation to request an arbitration rider.
21) Force Majeure
We’re not responsible for delays or failures caused by events beyond our control (storms, outages, strikes, new regulations, etc.).
22) Changes to These Terms
We can update these Terms at any time. When we do, we’ll post the new effective date. Continued use after changes means you accept the updated Terms.
